Registering a new food trailer in the United States

Both a federal pre-import requirement and a state selling-side requirement apply. A US-resident agent for service of process must be designated with NHTSA before the vehicle may be imported at all, and certification has to happen at the factory.

Approved before shipment

Approval must be obtained before the unit is shipped. We do not ship until it is.

Requirements

What the authority requires

RequirementEvidenceRead
49 CFR 551.46 requires every foreign manufacturer, assembler and importer to designate a US permanent resident agent for service of process with NHTSA before offering a vehicle for importation, and states that until it does so it may not import. The agent must be a US permanent resident or domestic firm and the function cannot be subcontracted.verified2026-09-04
49 CFR 591.5(b) admits a conforming trailer on a declaration with no government approval, but only if the certification label was permanently affixed by the original manufacturer and the unit carries a 17-character VIN bearing an assigned World Manufacturer Identifier. Neither can be created at the port.verified2026-09-04
The fallback route under 591.5(f) requires a Registered Importer and a bond of 150 percent of dutiable value, which is not commercially viable at this price point.verified2026-09-04
An onboard generator triggers a separate federal requirement. EPA Form 3520-21 must be filed with CBP for every imported nonroad engine, and admission requires a valid EPA certificate of conformity and an English emission control label.verified2026-09-04
The Manufacturer's Statement of Origin is a state titling instrument. Without it and the Part 567 label the buyer cannot title, register, insure or finance the unit.verified2026-09-04
Dealer licensing is state level. Texas, for example, requires a General Distinguishing Number for each location and requires the dealer's office physical address to be in Texas.verified2026-09-04

For your order

How we handle it

Certification happens at the factory at build time, a US-resident agent is a precondition of import, and selling into a state needs a dealer licence with a physical address there.
